1. Acceptance of Terms
By accessing and using the services of Ability Web Tech ("we," "us," or "our"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by these terms, please do not use our services.
2. Services Provided
Ability Web Tech, operated by Ikechukwu Nwoke, provides the following services:
- Custom website design and development
- E-commerce website development
- Website maintenance and updates
- Cybersecurity consulting and audits
- Domain registration and hosting assistance
- Website optimization and performance improvements
3. Service Agreement & Payment Terms
When you engage our services, the following terms apply:
- Payment Schedule: A 50% deposit is required before work begins, with the remaining 50% due upon project completion and before final delivery.
- Project Timeline: Delivery times are estimates and depend on client feedback and content provision. Delays caused by the client may extend the timeline.
- Revisions: Each package includes a specific number of revision rounds. Additional revisions may incur extra charges.
- Cancellation: If you cancel a project after work has begun, the deposit is non-refundable. If the project is 50% complete or more, full payment is required.

All prices are in Nigerian Naira (₦). Payment can be made via bank transfer or other agreed-upon methods. Projects will not commence until the deposit is received.
4. Client Responsibilities
To ensure successful project completion, clients agree to:
- Provide all necessary content (text, images, logos) in a timely manner
- Respond to requests for feedback within 5 business days
- Provide accurate information about their business and project requirements
- Obtain necessary permissions for any content they provide
- Make timely payments as agreed in the service contract
5. Intellectual Property Rights
Upon Full Payment:
- You will own the final website design and custom code developed specifically for your project
- You retain all rights to content you provide (text, images, logos)
Ability Web Tech Retains:
- Right to display the completed work in our portfolio and marketing materials
- Ownership of any pre-existing code, libraries, or frameworks used in your project
- Right to reuse general code patterns and solutions developed during your project
6. Third-Party Services & Tools
Our services may involve third-party platforms and tools, including but not limited to:
- Domain registrars (e.g., Namecheap, GoDaddy)
- Hosting providers
- Content Management Systems (e.g., WordPress)
- Payment gateways (e.g., Paystack, Flutterwave)
- Email services and form processors (e.g., Formspree)
You are responsible for any fees associated with these third-party services beyond the initial setup. We will inform you of all recurring costs before implementation.
7. Warranties & Limitations
We Guarantee:
- Professional workmanship and industry-standard coding practices
- Responsive design that works on modern browsers and devices
- 30 days of free bug fixes after project delivery
- Confidentiality of all project-related information
We Do Not Guarantee:
- Specific search engine rankings or traffic levels
- Website performance on outdated browsers (IE 11 and older)
- Results from marketing or business outcomes
- Uptime or performance of third-party hosting services
8. Limitation of Liability
Ability Web Tech shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use or inability to use our services. Our total liability shall not exceed the amount paid by you for the specific service giving rise to the claim.
9. Confidentiality
Both parties agree to maintain the confidentiality of any proprietary information shared during the course of the project. This includes business information, technical data, and any other sensitive materials.
10. Termination
Either party may terminate the service agreement with written notice. In case of termination:
- Client must pay for all work completed up to the termination date
- Ability Web Tech will deliver all completed work in its current state
- Any deposits paid are non-refundable if work has commenced
11. Modifications to Terms
We reserve the right to modify these terms at any time. Changes will be posted on this page with an updated "Last Updated" date. Continued use of our services after changes constitutes acceptance of the new terms.
12. Governing Law
These terms shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria. Any disputes shall be resolved in the courts of Rivers State, Nigeria.
